Content Engagement

Products and/or services must be provided by the brand. Brands must communicate content directives, encompassing post requisites, caption and image specifications, post date, time, and other particulars, before product delivery. Both the brand and creator must mutually agree on deliverables and direction before the product or service is rendered.

Content will be published within 10 - 14 days of product/service delivery. All content deliverables will bear the exploretomakan.com watermark by default. Additional services such as a copy of the content, raw files, watermark removal, rush jobs, content revisions, reshoots, product purchases, loading fees, or other special requests will incur additional charges. Please enquire if required. Unauthorized copying, alteration, distribution, paid media display, or other use of our material is prohibited and will result in legal action.

Creator warrants and agrees to maintain full compliance with all Competition and Consumer Commission of Singapore (CCCS) rules and regulations, as well as any other applicable laws. This includes tagging all posts with relevant hashtags, such as “#sponsored”, “#ad” or “#advertisement”, as well as, where applicable, including relevant disclosure statements and marking posts as “Paid Partnership”.

Ethical Disclaimer

Creator should not receive preferential treatment, and the product or service rendered should adhere to the standards offered to any other customer. Our commitment revolves around crafting content that is not only relevant but also truthful and beneficial for our viewers.

Brands are obligated to guarantee the satisfactory condition of the product or service. If deemed unsatisfactory, no content shall be published, and brands are encouraged to supply a replacement product or service, and we strictly do not entertain solicited positive reviews.

Confidential Agreement

Each party shall maintain the confidentiality of all Confidential Information pertaining to the Campaign and this Agreement. "Confidential Information" shall encompass any and all information (whether written or oral, and irrespective of whether it is specifically designated as confidential) disclosed or made available to the receiving party by or on behalf of the disclosing party in connection with the Agreement or in anticipation of a potential business relationship. Such information is non-public, confidential, sensitive, or proprietary in nature, and includes, but is not limited to:

A. Information related to the Promotions before the public launch of Promotions;
B. Information pertaining to remuneration for the Content Creator’s services.
C. All other information, data, and materials marked by the party as “confidential.”
D. Personal information of the Content Creator.

Both parties hereby commit to treating all Confidential Information with utmost care and shall not, without prior written consent from the disclosing party, disclose, reproduce, or utilize such information for any purpose other than the explicit objectives of this Agreement.

This obligation of confidentiality shall endure beyond the completion or termination of this Agreement, and each party shall take all necessary measures to ensure the preservation of the confidentiality of the disclosed information.

Payment Terms

Any payment involved shall be denominated in Singapore Dollars (SGD). Payment is exclusively to be executed through cashless methods, including, but not limited to, cheque, bank transfer, PayNow, or PayLah.

The commencement of creative works is contingent upon the acceptance and signature of the invoice by a duly authorized representative of the brand or company. An invoice will be generated upon mutual agreement and confirmation of collaboration. To confirm engagement, the brand is obligated to remit 50% of the agreed-uponfee. The remaining 50% must be settled no later than 24 hours before the mutually agreed-upon content publishing date. 

All payments are deemed final and non-refundable. Once a payment is made, it shall not be subject to refund, irrespective of the circumstances. This provision shall endure beyond the completion or termination of this Agreement.

All these Terms shall be interpreted in accordance with and governed by the laws of the Republic of Singapore, without reference to their rules regarding conflicts of law. Proceed with the collaboration only if you agree to the terms and conditions outlined above, as well as the perpetual effect of these terms post-collaboration or termination.
